1. Agreement to Terms

By accessing or using FloWizard's services ("Services"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our Services.

2. Use License

FloWizard grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal or business purposes. This license is subject to these Terms of Service and does not include:

  • Modifying or copying our materials

  • Using any materials for commercial purposes or for any public display

  • Attempting to decompile or reverse engineer any software contained within our Services

  • Removing any copyright or other proprietary notations

  • Transferring the materials to another person or "mirroring" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by FloWizard at any time.

3. Service Description

FloWizard provides workflow automation and system integration services to help businesses streamline their operations. Our Services may include consultation, implementation, customization, maintenance, and support as agreed upon in separate service agreements.

4. User Accounts

Some features of our Services may require registration for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Intellectual Property

The Services and all content, features, and functionality, including but not limited to all information, software, text, graphics, logos, images, and the design, selection, and arrangement thereof, are owned by FloWizard, its licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.

6. User Content

You retain all rights to any content you submit, post, or display on or through the Services. By providing content to FloWizard, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in any media.

You represent and warrant that you own or have the necessary rights to the content you provide and that the content does not infringe upon the rights of any third party.

7. Prohibited Uses

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

  • In any way that violates any applicable federal, state, local, or international law or regulation

  • To exploit, harm, or attempt to exploit or harm minors in any way

  • To transmit any material that is unlawful, threatening, abusive, defamatory, or otherwise objectionable

  • To impersonate or attempt to impersonate FloWizard, a FloWizard employee, another user, or any other person or entity

  • To engage in any activity that interferes with or disrupts the Services (or the servers and networks connected to the Services)

8. Fees and Payment

Some of our Services may require payment of fees. You agree to pay all fees in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable.

For subscription-based Services, you will be billed in advance on a recurring basis. You agree to provide us with complete and accurate billing information, including valid payment information.

9. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimer of Warranties

Our Services are provided on an "AS IS" and "AS AVAILABLE" basis. FloWizard expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

FloWizard makes no warranty that the Services will meet your requirements, be available on an uninterrupted, timely, secure, or error-free basis, or be accurate, reliable, or free of viruses or other harmful code.

11. Limitation of Liability

In no event shall FloWizard, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

12. Indemnification

You agree to defend, indemnify, and hold harmless FloWizard and its licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which FloWizard operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
